MELBOURNE AIRPORT’S MERRY MELBOURNE CHRISTMAS COMPETITION
TERMS AND CONDITIONS


On entering this competition you are agreeing to the following Terms and Conditions:

1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

1.2 This is a game of skill, with a minimum spend attached as a condition to entry. Passengers can enter this competition if they spend $20 in any T2, T3 or T4 retailer during the promotion period and tell us in 25 words or less what they would do with AUD $10,000 if they were the lucky prize winner. The winner of the AUD$10,000 prize will be chosen by the Promoter on the basis of the relevance, interest and creativity of their answer to the proposed question.

1.3 Each entrant will receive the same question to answer.

2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all permanent residents of Australia only over 18 years of age who spend $20 at any Melbourne Airport retailer in T2, T3 or T4 and complete the response to the question proposed in the entry form in 25 words or less.

2.2 Employees and families of the Promoter or the prize suppliers or any of their agencies associated with the Competition or Program are not eligible to enter. This includes a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption).

3. HOW TO ENTER

3.1 Entrants can enter by completing a paper entry form that will be available at T2, T3 and T4 Melbourne Airport Retailers following their purchase. The entrant will need to have spent $20 or more in one transaction and answer a question proposed to them within the entry form to enter. Entrants may only complete one entry form per transaction of at least $20. Multiple entries are permitted as long as each entry is the result of an individual transaction of at least $20.


3.2 Entrants must make their purchase at a T2, T3 or T4 Melbourne Airport retailer within the promotional period that commences on Monday 28th October 2015 and concludes at 11.59pm on 4th January 2016 (AEDST).

3.3 Entrants must physically drop their completed entry form into one of four entry boxes located throughout terminals 2, 3 and 4 at Melbourne Airport.

3.4 Incomplete or incoherent entry forms may be deemed invalid at the discretion of the Promoter.

3.5 Entry box locations:
Terminal 2
• Before Security/customs - Departures/Farewell Wall
• After Security/Customs – Just before Gates in front of retailer, Machinetta.
Terminal Three
• After security, Virgin concourse E (gates area) on Mezzanine Level in T3 on walkway opposite Hudsons Coffee.
Terminal Four
• After security, outside retailer Icons before Gates for Virgin/Rex/Jetstar

3.6 Entry to this competition is not available online.

3.7 Failure to comply with the above conditions or complete all fields required will deem the entry invalid and no correspondence will be entered into.

4. CRITICAL DATES

4.1 The Promotional Period for prizes commences at 12 midnight (AEDST) on the 28th October 2015 and closes at 11.59 pm (AEDST) on the 4th January 2016.

4.2 The Grand Prize winner of AUD$10,000 will be the entrant whose answer is chosen to be one with the most interest, relevance and creativity in response to the question. The judging will take place Thursday 7th January at 10am at the office of the Promoter, Australia Pacific Airport Management Office at Level 2, Terminal 2, Melbourne Airport, Tullamarine, Victoria 3043 (Promoter's Office). The total prize pool of this Promotion is AUD $10,000.

4.3 The AUD$10,000 prize winner will be contacted by phone and/or email and their name announced on the Melbourne Airport Facebook page and the website www.melbourneairport.com.au

4.4 If the grand prize is unclaimed a second judging will take place 90 days after the date of the first judging at the Promoter's Office in the week commencing Monday 7th March 2016. The winner will be chosen by the Promoter on the basis of relevance, interest and creativity of the answer to the proposed question (excluding the entry chosen in the first judging).

4.5 In such an event, the winners will be notified in writing and by phone and published on the website www.melbourneairport.com.au


5. MAJOR PRIZE

5.1 One (1) major prize consisting of AUD$10,000.

5.2 The winner must collect the prize in person at the Promoter's Office within 90 days of the winner being announced/contacted.

5.3 The winner must provide formal identification in the form of a Driver’s Licence OR valid Passport OR Birth Certificate – and have an Australian bank account (savings or cheque account but not a credit card). The winner must provide their BSB and Account number and the name of their bank and the account in writing so that the Promoter can directly deposit the funds into the nominated bank account by electronic funds transfer (EFT). The winner will be required to sign a letter in person that confirms their details are true and correct before Melbourne Airport will process the EFT. The Promoter will not take responsibility for incorrectly entered details/information in relation to bank account details and the EFT.

5.4 Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.

5.5 The Promoter reserves the right, at any time, to verify the validity of entries
and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

5.6 In participating in the competition, the winners agree to participate and co- operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non- exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.

5.7 The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

5.8 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity.

5.9 The Promoter’s decision is final and no correspondence will be entered into.


6. NO LIABILITY

6.1 CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY
WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND
LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL
LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT
PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT
ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

6.2 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation.

6.3 To the fullest extent permitted by law, the Promoter is not responsible for lost, interrupted communications or unavailable server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.

6.4 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

6.5 The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions of entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

6.6 Nothing in these Terms and Conditions limits, excludes or modifies or purports limit, exclude or modify the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (Non-Excludable Guarantees Liability).

6.7 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees Liability, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
